The Metrology Act of 2009 regulates trade and commerce in weights, measurements, and other things sold or provided through weight, measure, or numbers. It also defines and enforces standards for weights and measures. This Act is applicable all over India. The Act's registration is known as a Legal Metrology Packaged Commodity Licence or Legal Metrology Registration. All pre-packaged goods must comply with the Legal Metrology Act. It is necessary to employ the international units of measurement, which designate the following fundamental units.

Understanding LMPC Certificate

In recent years, stricter laws have been passed regarding the security and risk of importing pre-packaged goods. Rule 27 of the LMPC mandates that all importers, producers, and commercial packers register for LMPC Registration.

Traders who import pre-packaged goods must register with either the Central Government's Director of Legal Metrology or the state's Controller of Legal Metrology. If the application is accepted, the authorities will provide them with LMPC Certificates that include their name and address. Both the central government and state governments have the authority to grant registration.

What is Legal Metrology?

Legal Metrology is the branch of Metrology that deals with measurement and weight units, measurement and weight methods, and measurement and weight instruments about the necessary legal and technical requirements to ensure public assurance regarding the security and accuracy of the measurements and weights.

Legal Metrology is a branch of the Department of Consumer Affairs established in 2009 that oversees and regulates companies that manufacture, import, and operate various enterprises related to weighing and measuring devices. In addition to guaranteeing safety and security, developing an open and effective legal system that inspires trust in business, industry, and consumers and fosters a peaceful atmosphere for conducting transactions is essential.

Types of Legal Metrology Certificates

Here are the two types of Legal Metrology Certificates:

Importer Registration

If you import pre-packaged goods and sell them in India, you must get the LMPC importer registration. To import hazardous chemicals into India, an individual must comply with Rule 27 and register as an LMPC Importer. Under the LMPC Rules, anyone importing hazardous chemicals into India is required to get a registration certificate under Rule 27 from the Chief Controller of Explosives (CCoE). This certificate has to be renewed after its five-year expiration date.

In accordance with Rule 27, anyone wishing to import Pre-packaged goods into India must register for LMPC Importer Registration. This covers producers, distributors, and importers.

Packer & Manufacturer Registration

If you manufacture and package items yourself or if you have hired a third party to manufacture the goods and have them packaged under your brand, you must get this registration. The Food Safety and Standards Authority of India (FSSAI) mandates a registration procedure for packers and manufacturers of proprietary food items (PFAs), which is referred to as LMPC Packer & Manufacturer Registration under Rule 27.

Documents required for LMPC Certification

The following documents are required for LMPC certification in India:

·         Proofs of identity and address (passport, voter ID card, Aadhaar card).

·         Authorized signatory's DSC certificate.

·         NDMC/MCD/DDA license for factory, trade, or manufacturing. If the applicant does not have the MCD license, an affidavit certifying that the business premises are not situated in a non-conforming area must be submitted with the seal of MCD.

·         Certificate of GST Registration.

·         For partnership businesses, the partnership deed; for corporations, the Memorandum of Association.

·         Code for Import Export (IEC).

·         Passport-sized pictures (of each director, partner, and business owner).

·         Proof of place of business.

·         Labels, slips, stickers, and packaging materials adhered to the packed goods.

The steps for obtaining a legal metrology certificate can be understood as

follows:

Submission of application: The application form must be submitted to the local government office to apply for the LMPC Certificate for Import.

Submit the Required Documents: You must also submit all necessary documentation with your application for the LMPC certification.

Payment of LMPC Registration Fees: After completing the application and submitting the necessary paperwork, you must pay the legal metrology registration fee. Following submission, the director of Metrology reviews the application, who then determines whether to approve or deny it. After obtaining the certificate, the legal metrology certificate is issued within 7 - 10 working days.
